Acceptable Use Policy

1. Overview

This Acceptable Use Policy ("AUP") sets out the rules for using ApexGen and applies to everyone with access to an ApexGen account, in addition to our Terms of Service. Violating this AUP may result in suspension or termination of your account.

2. Messaging & Outreach

You must not use ApexGen to:

• Send unsolicited bulk messages ("spam") or messages to purchased/scraped contact lists without a lawful basis to contact them
• Contact individuals who have opted out, unsubscribed, or withdrawn consent
• Violate the CAN-SPAM Act, TCPA, CASL, GDPR, UK PECR, or any other applicable anti-spam or telemarketing law
• Send messages that are deceptive, impersonate another person or business, or misrepresent the sender
• Use the platform to facilitate phishing, smishing, or other fraud

3. Content Restrictions

You must not upload, generate, or transmit content that:

• Is illegal, harassing, defamatory, or discriminatory
• Infringes someone else's intellectual property or privacy rights
• Promotes violence, self-harm, or exploitation of minors
• Relates to illegal goods or services (e.g. controlled substances, weapons, counterfeit goods)
• Contains malware, viruses, or code intended to disrupt systems

4. System & Platform Abuse

• Attempting to circumvent rate limits, credit metering, or usage caps
• Probing, scanning, or testing the vulnerability of our systems without prior written authorization (see our Security page for how to report issues responsibly)
• Reverse engineering, decompiling, or attempting to extract the source code or models underlying the Service
• Using automated scripts to create accounts, scrape data, or generate excessive load against our API or AI assistant beyond normal interactive use
• Reselling or sublicensing access to the Service without our written consent

5. AI Features

AI-generated messages and the in-app AI assistant must not be used to impersonate a real human without disclosure where required by law, to generate content that violates Section 3 above, or to make automated decisions about individuals that produce legal or similarly significant effects without human review. 6. Reporting Violations

If you believe someone is using ApexGen in violation of this policy, contact apexgenteam@gmail.com. We investigate reports and take action ranging from a warning to immediate account suspension, depending on severity.

7. Enforcement

We reserve the right to suspend or terminate access, remove content, or throttle usage at our discretion where we reasonably believe this AUP has been violated, without prejudice to any other rights under our Terms of Service.
